Web Site Privacy Policy

This Web Site Privacy Policy applies to your use of www.clariseyecare.com (the “Site”). This Privacy Policy discusses what information we collect through the Site, how we use it, and how we protect it. Patients of Claris should also consult the applicable Notice of Privacy Practices for information about how we collect, use and protect patient information we receive out of our patient relationships. By using, browsing or accessing the Site, you agree to the terms of this Web Site Privacy Policy. Your visit to the Site is subject to our web site Terms of Use, including limitations on damages and application of the law of the state of Minnesota. Use of this Site is strictly voluntary. 1. What personally identifiable information is collected from me?

We do not collect information at this Site that directly identifies your name or contact information (e-mail address, telephone number, home address) unless you choose to provide that information to us, such as when you send an e-mail.

2. What other kinds of information does the Site collect and how is it used by Claris?

Our site collects some information about your web visit to the Site, and may also place a “cookie” on the computer you use for the visit. When you visit the Site you necessarily disclose your computer’s Internet protocol (IP) address. Your IP address is a number that is used by computers connected to the Internet to identify your computer so that data (such as the web pages you request) can be sent to your computer. In some cases, a person knowing an IP address may be able to associate it with a person or a known computer, but Claris does not use IP addresses for this purpose, nor does it disclose the IP addresses of Site visitors to third parties. 3. How is my information used and with whom is it shared?

If you choose to submit any personal information to us, either through the Site or other means, unless we know the information is subject to a doctor/patient relationship we have both chosen to establish with each other (in which case that information will be subject to the Notice of Privacy Practices), the personal information that you submit may be shared with Claris employees and contractors who need this information to respond to your question or request. Claris may use the information you provide on this Site for particular activities, including, without limitation: customer service and support; to conduct research, marketing, or data processing; collections; provide marketing or promotional services for Claris; and to contact you regarding administrative notices. Claris may share this information with Claris’ agents, contractors or business partners in connection with any of the foregoing activities. Except as described above, Claris will not give or sell your information to any other company for its use in marketing or solicitation.

Notwithstanding, Claris does research on our users’ interests and behavior based on the information provided to us during your use of the Site. On occasion Claris may aggregate the above-mentioned data to track overall Site visitor traffic patterns. Aggregated data does not include personally identifiable information. Claris may share this aggregate information with vendors, business partners, or other third parties. We may disclose personal information in any of the following circumstances: (1) in response to a subpoena, search warrant, court order, or other legal process or request, or as may otherwise be required by applicable law or regulation; (2) to protect and defend our rights or property or those of our affiliates, dealers, business partners, or others; or (3) as we, in our sole discretion, believes is appropriate under exigent circumstances in response to a perceived threat to the personal safety, property, or rights of any other person or organization. Claris does not associate your IP address with any other personally identifiable information, except in case of violation of the Terms of Use.

In addition, since our database is a business asset, in the event Claris is reorganized or is sold to or merged with another company, you consent to the sale, assignment, or transfer of your personal information to a purchaser of all or substantially all of Claris’ business assets, or to an affiliate, as applicable.

4. What else should I know about my privacy?

Claris takes what it believes to be reasonable precautions and security measures to safeguard the security of information sent and received on the Site, including personal information. Nonetheless, neither the Site, nor use of e-mail, provides a completely secure and confidential means of communication. While we do not have reason to believe it is occurring, it is possible that the information you send through the Site or by e-mail may be accessed or viewed by an unauthorized third party while in transit to us. Such access is beyond our control.
